Maybe, and maybe not. Legal protections are afforded involved duty service members that may prevent you from suing for divorce.
Depending on his branch of service, the “Servicemembers Civil Relief Act” (SCRA) or the Soldiers’ and Sailors’ Civil Relief Act (SSCRA)applies.
Simply put, if he objects, you can not bear court action (including divorce, custody, etc) against him while he remains on moving duty.

I am in the Army and it doesnt stop you from civil schedule. You can still be sued, divorced, summoned, jury duty, etc. If that is what he thought be a way to "keep" you, he is wretchedly mistaken.
